Equipment Rental & Cancellation Policy

SCOOTERS:

SCOOTERS MAY BE DAMAGED IF DRIVEN THROUGH OR EXPOSED TO ANY WATER SOURCES
INCLUDING: RAIN, STANDING WATER OR RISING WATER

I, listed below (the operator or representative of the operator whether legal or not) will be herein known as “I”. I acknowledge this waiver will be kept on file and will apply to any and all current or future rentals with no expiration until such time I have requested in writing for this waiver to be no longer applicable. I acknowledge I am renting a mobility scooter (3 or 4 wheel) and it is designed as a single person vehicle. I must be at least 18 years of age to operate the scooter and present a valid state issued driver’s license. Operators 18 to 20 years must have the signature of a parent/legal guardian over the age of 21. I will be legally responsible for all terms and conditions listed in this waiver and will ensure the actual operator has been instructed on the inherent dangers and safe operation of the scooter.

I hereby acknowledge that I have received training on the operation and safety precautions associated with the use of this scooter via any of the following methods: training videos, instructional sheets or in person and I agree to abide by these instructions.  If at any time I am unsure about the operation or usage limitations of the scooter, I acknowledge that I am responsible for requesting additional training and instructions before operating the scooter. I agree to not allow others to ride or operate the EMV. I understand the scooter weight limitations set forth (300 lbs for standard and 450 lbs for heavy-duty) and acknowledge the operator is within that weight limit. I acknowledge the operator will not be under the influence of alcohol or any type of drug that could inhibit the ability to safely operate the scooter at any time during operation.  I understand scooters may weigh up to several hundred pounds and can travel at speeds of up to 5 miles per hour. Misuse of this scooter can cause death or severe bodily injury to both the operator and/or bystanders. Due to the design of any scooter, there is an inherent risk of tipping over which can cause bodily injury, death and property damage. Furthermore, I understand that I will be legally responsible for any and all liability claims, for personal injury, death and/or damage to property including the scooter/s that is caused by the operator or anyone allowed use of the scooter with or without permission. AABA Family Medical Supply and its affiliates, agents, associates or employees shall not be liable or responsible for and shall be saved and held harmless and indemnified by me from and against any and all claims and damages of every kind, for the injury to or death of any person or persons and for the damage to and loss of property, arising out of or attributed directly to the use or rental of the scooter during the rental period.

I will inspect the scooter before operating unit. Any and all damage will be brought to the attention of an AABA associate and will be noted on the damage acknowledgment form at the time of delivery. The scooter will be returned in the same condition as when initially rented other than normal wear and tear. I will be responsible for any damage to the scooter not documented on the damage acknowledgment form.

Scooters are not permitted for use on the beach or any type of sand. If the scooter is returned with signs of use on sand there will be a $50 cleaning fee and I will also be responsible for any damage caused by sand. A $50 cleaning fee may also apply for scooters returned excessively soiled.

Scooters returned past the contracted time limit, will be billed at a rate of $5.00 up to one (1) hour; beyond that, the renter will be charged an additional day’s rental fee. In the event of any lost and/ or damaged key(s), I will be charged $10.00 to cover the replacement cost plus delivery if applicable.

SCOOTER DISASSEMBLY/RE-ASSEMBLY FOR PORTABLE SCOOTERS:

I hereby acknowledge that I have been instructed on assembly and disassembly of the scooter.  Damage can occur during disassembly and reassembly. I will be responsible to pay for any damage caused during disassembly or reassembly of the scooter.  The most common damage upon reassembly occurs to the power connector pins. General repair cost of the connector pins is approximately $350.

I, the operator or responsible party and/or parent/legal guardian (for operators 18 to 20 years of age) listed below,  have read and fully understand all of the terms, conditions and rules set forth above, and agree to all terms without reservation.

BEACH WHEELCHAIR/MOBI CHAIR:

  1. The Beach wheelchair is not a flotation device and therefore is not designed for use in water.
  2. The Mobi-Chair is designed for use in water and is designed to float. The weight capacity is approximately 300 lbs. I acknowledge a life jacket should be used for non-swimmers (This may be required by law). The chair is not intended for use in current or strong waves. I will not disassemble any parts and use them as separate flotation devices.
  3. Beach wheelchairs and/or mobi-chairs must only be loaded with weight on the beach. Use of a weight loaded chair on any surface other than the sand may cause damage to the tires. Chairs must never be used on any type of boardwalk due to the risk of tire damage. The renter will be responsible for the cost of tire damage due to improper use. Replacement tires can cost $200.00 each or more.
  4. The caregiver, or person pushing the beach wheelchair and/or mobi-chair should be in relatively good physical condition, as pushing the chair could be somewhat difficult especially on areas of the beach where there is soft sand.
  5. Our beach wheelchairs and/or mobi-chairs are high-quality stainless steel and retail for about $3000 each.
  6. Chairs have an articulating adjustable foot platform, removable arms, and umbrella.
  7. At all times, in all situations, I am ultimately responsible for safeguarding the beach wheelchair against theft or damages. The beach wheelchair and/or mobi-chair must be stored in a secure location when not in use.
  8. If I am staying at a hotel, or other dwelling, it will be my sole responsibility to obtain authorization from hotel management, the owner(s), or lessor(s) to store the beach wheelchair and/or mobi-chair on-site in a secure location for the duration of the rental period.
  9. There are no refunds or partial refunds for inclement weather, illness, or early equipment returns. Exceptions may be made at the sole discretion of management.
  10. Extension requests may be honored as long as it does not conflict with a pre-existing reservation.

CANCELLATION POLICY FOR ALL RENTALS:

NO REFUNDS DUE TO WEATHER:

  1. BEACH WHEELCHAIRS, MOBI CHAIRS AND SCOOTER RENTALS CANCELLED PRIOR TO DELIVERY OF EQUIPMENT WILL BE CHARGED A 50% PROCESSING FEE OF THE BASE RENTAL PRICE. ALL OTHER EQUIPMENT RENTALS CANCELLED PRIOR TO DELIVERY WILL BE CHARGED A 10% PROCESSING FEE OF THE BASE RENTAL PRICE.
  2. CANCELLATION FEES WILL BE WAIVED IF WE ARE ABLE TO RENT THE SAME ITEM/S FOR THE ORIGINAL LENGTH OF TIME OR LONGER.
  3. REFUNDS WILL NOT BE MADE FOR ANY EQUIPMENT CANCELLED OR REFUSED AT THE TIME OF DELIVERY.
  4. REFUNDS WILL NOT BE MADE FOR ANY UNUSED PORTION OF THE RENTAL PERIOD.
  5. IF A COMPLETE OR PARTIAL RENTAL CHARGE IS DISPUTED THROUGH YOUR BANK OR CREDIT CARD, A $35 PROCESSING WILL BE CHARGED IN ADDITION TO A 10% CHARGE OF THE TOTAL RENTAL PRICE. Please call AABA Family Medical Supply BEFORE disputing the charge so we can try to rectify the situation before any requested dispute. The customer must have a valid credit card and ID at the time of reservation and agree to keep the valid credit card on file until after the rental item is returned.
  6. All equipment must be returned in the same condition as it was provided. Normal wear and tear are acceptable.

I agree to safeguard the equipment and reimburse AABA Family Medical Supply for any theft, loss or damage of any type to the rented equipment.

    • Keep both Feet on Platform
    • Use on Beach or Docks Prohibited
    • Insert and Remove Key
    •  Use Accessible Entrances
    • Yield to Pedestrians
    • Drive/Free Wheel Operation
    • Enter and Exit Elevators Cautiously
    • Avoid Escalators, Stairs and Wet Surfaces

I hereby acknowledge that I have received training on the operation and safety precautions associated with the use of this scooter via any of the following methods: training videos, instructional sheets or in person and I agree to abide by these instructions. If at any time I am unsure about the operation or usage limitations of the scooter, I acknowledge that I am responsible for requesting additional training and instructions before operating the scooter. I will be responsible to pay for any damage caused during disassembly or reassembly of the scooter. The most common damage upon reassembly occurs to the power connector pins. General repair cost of the connector pins is approximately

I acknowledge a life jacket should be used for non-swimmers (This may be required by law). The chair is not intended for use in current or strong waves. I will not disassemble any parts and use them as separate flotation devices.
    3. Beach wheelchairs and/or mobi-chairs must never be used on any type of boardwalk due to the risk of tire damage. The renter will be responsible for the cost of tire damage due to improper use. Replacement tires can cost $150 – $300 each.

    3. ALL OTHER EQUIPMENT RENTALS CANCELLED PRIOR TO DELIVERY WILL BE CHARGED A 10% PROCESSING FEE OF THE FULL RENTAL PRICE IF CANCELLED BEFORE THE DAY OF DELIVERY.

    I, the legally and financially responsible party below have read, fully understand and agree to all the terms, conditions and rules set forth in this agreement without reservation. I agree to reimburse AABA Family Medical Supply damage, loss or theft of ANY equipment rented including equipment not specifically listed in this policy. If a security lock is provided to safeguard the equipment, the financially responsible party below is still responsible for theft of the item. I acknowledge that my digital signature constitutes a legal signature. I agree this form will be kept on file and be legally applicable to any future rentals.
